Indiana Governor Signs COVID-19 Immunity Legislation

 

On February 18, 2021, Indiana Governor Eric Holcomb signed Senate Bill 1 into law. This legislation provides immunity from damages to individuals and businesses for damages arising from COVID-19. The legislation, however, does not provide protection for individuals or businesses whose acts or omissions constitute gross negligence or willful or wanton misconduct. This law is codified as Indiana Code § 34-30-32-et. seq. The law also provides immunity to manufacturer or supplier of “COVID-19 protective equipment” which includes, medical devices and supplies use to treat COVID-19, medications used to treat COVID-19, diagnostic tests, and products designed to clear or disinfect to prevent the spread of COVID-19.
